NOTE: This page is provided to all users of the Marin FilmWorks Web site and presumes usage of all services provided from this site. Copyrighted Works
Purchaser represents and warrants that by requesting Marin FilmWorks to reproduce any copyrighted work, purchaser either has:
a) Obtained permission from the copyright owner to reproduce, distribute, display or in any way use such copyrighted work;
OR
b) Will use the reproductions prepared by Marin FilmWorks solely for teaching, research, scholarship or for criticism, comment or news reporting and will not sell the reproductions or use the reproductions in any manner which is to the direct financial benefit of the purchaser and the financial detriment of the copyright owner.
Purchaser agrees to hold harmless and indemnify Marin FilmWorks for all expenses, attorney's fees, or judgements resulting from any claim or lawsuit against Marin FilmWorks for copyright infringement or any other claim or lawsuit against Marin FilmWorks arising out of any alleged claim for invasion of privacy or defamation, regarding purchaser's order(s).
Marin FilmWorks asks all users of the WebWorks upload and print service to observe all copyright restrictions on prints intended for upload and printing. To be sure of the status of a scanned image, the copyright information is clearly printed on the back of all prints that are owned by a photographer or other individual. Generally, a date and the word "Copyright", often accompanied by the photographer's name or a studio's name, will be visible on the back of the print.
Freedom of Speech Issues
Marin FilmWorks is also not liable for printing images that may not be protected under "freedom of speech" laws. In extreme cases, Marin FilmWorks reserves the right, or may be required by law, to report questionable content to the authorities.
Limits of Liability
When you submit negatives, transparencies, artwork, or other related materials to Marin Filmworks, that constitutes an agreement by you that any damages or loss caused by us, which includes negligence or any other fault by Marin Filmworks, will entitle you only to replacement with like amount of unexposed film and processing. Except for such replacement, the acceptance of the film is without other warranty or liability, expressed or implied, and recovery for any incidental or consequential damages are excluded. This also includes those photographers who leave negatives with us for storage, we do this as courtesy only.
Miscellaneous
Turn-arounds are approximate and may vary depending on workload. We have built our reputation on our service as well as our ability to produce a creative project. However, sometimes the demand on our time and ability creates a situation where our turn-around has to be increased to maintain our consistent quality. Every job is important to us as well as you. Thank you for understanding.

Cancellations will be charged for all work completed.
Marin FilmWorks reserves the right to refuse service to anyone at anytime.
Marin FilmWorks is not responsible for orders left over 30 days, all unclaimed orders may be destroyed after 60 days.
Marin FilmWorks employs technicians to develop each image submitted to us. We do our best to produce a corrected images for a natural or realistic reproduction of color, brightness, and contrast, etc. Digital files submitted to us via the WebWorks upload service will receive the same correction we have always utilized in our conventional film processing.
All quantity breakdowns apply to prints made from the same original.
We are not responsible for any mis-print or typing errors. |
